1. General Info & Definitions

  • “Company,” “We,” “Our,” and “Us” refer to Delivery Baba, operating primarily out of Berhampore, West Bengal, India.
  • “Platform” refers to the website deliverybaba.in and any associated mobile applications.
  • “User,” “You,” and “Your” refer to you, the person logging on to this website and compliant with the Company’s terms and conditions.
  • “Products” refers to the groceries, FMCG goods, household items, and any other goods listed for sale on the Platform.

2. Eligibility and Account Registration

  • Age: You must be at least 18 years of age to register, use the Services, or visit or use the Platform in any manner.
  • Accuracy: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • Security: You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.

3. Pricing and Product Availability

  • Pricing: All prices listed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless stated otherwise.
  • Fluctuations: Due to the nature of the grocery market, prices of certain items (especially fresh produce) may fluctuate daily. The price charged will be the price applicable on the day the order is placed.
  • Availability: All orders are subject to product availability. We reserve the right to limit the quantity of any product supplied to a single customer or household.
  • Variations: Slight variations in weight/size may occur for loose items (e.g., fresh vegetables). You will be billed only for the exact weight delivered.

4. Orders, Delivery, and Shipping

  • Service Area: We currently process and deliver orders exclusively within Berhampore, West Bengal, and specified surrounding pin codes. Orders placed outside our operational zones will be automatically canceled and refunded.
  • Delivery Slots: Deliveries are scheduled based on the time slot selected by you during checkout. While we strive to deliver within the promised window, unforeseen circumstances (traffic, weather, etc.) may cause delays.
  • Delivery Charges: A nominal delivery fee may apply depending on the total order value and delivery location. This will be clearly displayed at checkout before payment.
  • Receiving Orders: It is your responsibility to ensure someone is available at the delivery address to receive the order.

5. Cancellation, Returns, and Refunds

  • Cancellation by User: You may cancel your order at any time before it is dispatched from our fulfillment center by contacting customer support or via the Platform.
  • Cancellation by Us: We reserve the right to cancel an order due to suspected fraud, lack of stock, or logistical issues. You will be fully refunded in such cases.
  • Returns: We have a “no questions asked” return policy at the time of delivery. If you are dissatisfied with the quality, freshness, or packaging of a product, you may hand it back to our delivery executive.
  • Refunds: For products returned at the door, the corresponding amount will be deducted from your final bill (for Cash on Delivery) or refunded to your original payment method within 5-7 business days (for prepaid orders). Perishable goods cannot be returned once accepted.

6. Payment Terms

  • We offer multiple payment options, including UPI, Credit/Debit Cards, Net Banking, and Cash on Delivery (COD).
  • Delivery Baba reserves the right to disable COD for specific users or delivery zones based on past order history or operational feasibility.

7. Intellectual Property Rights

Unless otherwise stated, Delivery Baba and/or its licensors own the intellectual property rights for all material on deliverybaba.in (including logos, branding, text, and graphics). All intellectual property rights are reserved. You may access this from Delivery Baba for your own personal use subjected to restrictions set in these terms and conditions.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Delivery Baba shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform.

9. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India. Any disputes relating to these terms and conditions will be subject to the exclusive jurisdiction of the courts located in Berhampore, Murshidabad district, West Bengal.

10. Modifications to the Terms

Delivery Baba reserves the right to revise these Terms and Conditions at any time without prior notice. By using this website, you are expected to review these Terms on a regular basis.
